Reasons

The landlord attended the hearing today. The tenant did not attend.
The landlord has applied for termination of the tenancy, rent arrears, compensation, exemplary damages and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The arrears have not improved, and the tenant vacated the premises on 4 December 2025. It is appropriate to confirm that the tenancy is terminated, and the landlord is granted possession.
The landlord provided rent and water records which prove the amounts owing at the end of the tenancy. Methamphetamine Costs
The landlord says the tenant used the premises unlawfully to smoke or manufacture methamphetamine. Testing has been performed. The highest reading was 4.09ug/100cm². There is one reading above 1.5ug/100cm² and the remaining readings are below that level.
The levels of contamination probably do not enable the landlord to claim the cost of decontamination (although I make no finding to this effect) but do support the landlord’s claim that illegal drugs have been used at the premises. The landlord told me that the property was brand new when the tenant moved in, and she was the first tenant.
It is an unlawful act to use premises for an unlawful purpose and exemplary damages may be awarded up to a maximum of $1,800.00 (section 40(2)(b) of the Residential Tenancies Act 1986).
As decontamination has not occurred yet, it was agreed not to address exemplary damages now. I note that the quoted cost of decontamination is $3,450.00.
I am satisfied that the landlord can recover the testing costs as compensation for breach of section 40(2)(b). The landlord performed testing because they were concerned methamphetamine was being used and the findings supported that concern.
A standard screening assessment was performed ($389.85) with further processing of the composite test ($172.50) and a detailed assessment ($2,157.98). I award these costs. Filing Fee and Suppression
