Order
- Benjamin Romeo Kalolo and Fiona Kauma Tausi owes Kāinga Ora–Homes And Communities $8,810.00 being rent and rent arrears to 16.2.2026 (“the debt”).
- Benjamin Romeo Kalolo and Fiona Kauma Tausi must pay rent and the debt as follows: a. By weekly payments of current rent and $60.00 for the debt. b. Payments will be every Tuesday, with the first payment on 17/02/2026 and continuing until the debt is paid in full and there are no rent arrears.
- Payments will be allocated in the following order: rent, rent arrears.
- If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at Unit/Flat 3, 1 Robert Burke Place, Henderson, Auckland 0612 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

- The tenant was telephoned on the phone number provided but the phone call went unanswered. I am satisfied the tenant was properly served with notice of the hearing. The hearing proceeded in their absence.
- The landlord has applied for termination of the tenancy and rent arrears. The landlord and the Tribunal assume that the tenants want to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. 1
- I am satisfied the tenants will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. While I have not heard from the tenant’s because they did not attend the hearing I have confidence that the landlord will explain this order and assist the tenant in complying with it. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. 2 Rent arrears
