Some progress has been made but the photographs taken on 16 January 2026 show a significant amount of rubbish in the grounds and one photo through the open door of the caravan reveals it is full of rubbish.

Although the application referred to the lawns and inside the property, the landlord said that some progress has been made with the lawns, and they do not have current photographs of the inside of the property.

Therefore the landlord wants the outside of the property cleared of rubbish as well as the inside of the caravan.

Under section 40(1)(c) of the Residential Tenancies Act 1986, a tenant must keep the premises reasonably clean and tidy.

Where the Tribunal finds the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work. See section 78(1)(e) Residential Tenancies Act 1986.

If the work order is not being made by consent of both parties, the Tribunal must also make a monetary order as an alternative to compliance with the work order. See sections 78(2) and 78(2AA) Residential Tenancies Act 1986.

A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work, if the tenant should fail to comply with the work order and alternative monetary order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly. See sections 78(2AAB) and 78(2AAC)(a) Residential Tenancies Act 1986.

Based on the photographs provided, I am satisfied that the tenant has not complied with her obligations under the Act. I therefore make an order that she remove and dispose of all rubbish inside the caravan and on the grounds of the premises, outside the house.

The landlord did not have instructions to seek a monetary order as an alternative, but if the tenant does not comply with the work order, leave is granted to the landlord to return seeking such an order.

The tenant should also understand that ongoing breach of her obligations could lead to the landlord seeking termination of the tenancy.
