Reasons
- The landlord attended the hearing today.
- The landlord had applied for termination, rent and outgoings, reimbursement of the bond and the filing fee.
- The landlord sought to amend their application at the hearing to include lawns, cleaning costs and repairs. I allowed this, but on the basis that if the tenants disagree with the order in respect of these further claims, they should apply for a rehearing, and it will be granted on the papers. - The tenants vacated the premises on 31 December 2025. They had agreed to a fixed-term tenancy until 20 March 2026. The landlord has not yet been able to re-let the premises, but they are now in the process of advertising.
- Contractually the tenants are liable for rent to the end of the fixed term. The landlord is also under an obligation to take all reasonable steps to mitigate their loss by finding replacement tenants. There is nothing to suggest they have not done so.
- I award rent arrears to 16 February 2026 as claimed.

- The landlord’s photographs show that the premises needed cleaning at the end of the tenancy to ensure a reasonable standard of cleanliness. The carpet was badly stained. The floors and cupboards needed cleaning and there was a problem with pests.
- The lawns needed mowing at the end of the tenancy. The large section was overgrown. Damage
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
- Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks rent.
- Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
- There were several holes in the wall of bedroom 1 and scratch marks in bedroom 3. The cost of repair was $724.50, which is less than the insurance excess of $750.00. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. Filing Fee
