The tenant has not responded to communication from the landlord by letter, phone and email. So, the landlord is unable to contact the tenant and has been unable to agree with the tenant on a period for the tenant to collect the goods. The landlord has been paying for storage since the tenant was evicted.

It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore the landlord may dispose of the goods, after the tenant has one final opportunity to collect them. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.

[The tenant/s] must collect all his possessions currently stored by the landlord before 11:59pm on Thursday, 12 March 2026. He may do so by contacting the landlord on 0800 801 601 and asking to speak to his Housing Support team leader.

If Mr Tuhega has not collected his goods by 11:59pm on Thursday, 12 March 2026: a. Kāinga Ora–Homes And Communities must take any of the tenant’s personal documents that are still in its possession to the nearest Police station and obtain a receipt for them. Some items have already been delivered to the Police and Mr Tuhega was advised of that. b. The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit (from 12.01am on Friday, 13 March 2026).
