Order
- Alwyn James Nieuwelaar owes Kāinga Ora–Homes And Communities $1,556.57 (“the debt”) being rent arrears to 26/02/2026.
- Alwyn James Nieuwelaar must pay Kāinga Ora–Homes And Communities $152.00 on Friday 27 February 2026 and on Friday every week thereafter being $102.00 towards current rent and $50.00 towards the debt in order 1) until the debt is paid in full.
- Payments will be allocated to rent and then to rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat Unit 23, 432 Great North Road, Grey Lynn, Auckland 1021 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- The applicant attended the hearing by video link. The respondent did not attend or answer. The applicant told me the respondent has not paid rent since October and they were seeking a payment plan with a consequential order or an immediate termination.
- After the applicant left the hearing the respondent joined by video link. They acknowledged the debt and suggested a payment plan of $50.00 per week.
- Although the applicant had already left the hearing I am satisfied that the proposal is in line with the applicants preference in terms of outcome.
- The applicant has provided a rent summary showing the amount owing. I am satisfied this record is correct.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
