Reasons

Both parties attended the hearing.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed.

The grounds for terminating the tenancy are proved. 1

In the circumstances, extending the termination date for 2 weeks, so the tenant has fair opportunity to vacate the premises, is just. That is on condition that the tenant pays rent for that period and the arrears payments set out in the Orders above are made.

The landlord’s application includes a claim from the cost of repairing water damage. There is insufficient evidence available for that claim to be fairly determined today.

The landlord will need to bring evidence to prove; a. that the damage was caused through a breach of the tenant’s obligation to notify the landlord about the damage 2 ; b. the amount of the loss caused (including whether insurance cover is available).

The Tribunal will need to consider whether the landlord took reasonable mitigation steps (eg. by undertaking regular inspections of his property) 3 and whether the repair work will result in an improvement value for the landlord which should be accounted for.

Once the tenancy has ended the landlord will have the opportunity to assemble that evidence and can then bring a further claim if the issues cannot be resolved direct with the tenant.

It may also be relevant to consider s.49B RTA under which a tenant’s liability for a careless act or omission, is limited to 4 weeks’ rent. 1 S.55(1)(a) RTA 2 S.40(1)(d) RTA 3 S.49 RTA

I noted to the landlord at the hearing that I could not find any record of the tenant’s bond being held at the Bond Centre and asked that he provide the bond number. A number was provided, following which, after enquiries with the Bond Centre the landlord was advised on 29 January 2026: “I have checked and that is not the bond number. It relates to a different tenancy and was refunded in 2011. There is another bond held with that number but suffix -014 but that is also for a different tenancy. If the landlord in unable to provide a bond number for this bond by the end of the day tomorrow, I will need to assume the bond was not lodged with the Bond Centre and proceed accordingly”

Nothing further has been received from the landlord so I cannot make an Order for the bond to be paid to the landlord from the Bond Centre.

Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
