The applicant has provided photographs showing that the external and internal of the tenancy address is littered with an extraordinary amount of rubbish.

On 25 February, the Tribunal made an order requiring the tenant to remove all rubbish from the property and return the premises to a reasonably clean and tidy state. A declaration was also made that the condition of the property constituted a breach of section 40(1)(c), which requires a tenant to keep the premises reasonably clean and tidy.

In relation to this breach, the landlord issued the tenant with a 14-day notice under section 56 on 17 November 2025.

At the time of the second hearing, the notice of hearing did not include termination as a remedy sought, and I therefore adjourned the hearing. The matter came before me again on 15 July 2026.

In the photographs provided for that hearing from an inspection 2 days prior on 13 July 2026, the property is in the same, if not worse, condition. A large quantity of cans and rubbish is littered throughout the property, with no visible walking space.

Section 56 provides that, where a party commits a breach capable of remedy and the applicant has given the other party notice specifying the nature of the breach and requiring that party to remedy the breach within a reasonable period of not less than 14 days, and the other party has failed to remedy the breach within the period specified, the Tribunal may terminate the tenancy if it would be inequitable to refuse to make such an order.

In the circumstances, given that this is the third hearing concerning this matter, there has been no progress in remedying the breach and no engagement by the tenant or indication of any intention to comply. I am satisfied that it would be inequitable to refuse the landlord's application for termination of the tenancy.
