Reasons
- a video hearing was conducted today. The landlord’s representative appeared, however the tenant had not joined the meeting at the assigned time. I delayed the start of the hearing to allow for lateness, however, after a reasonable period of time the tenant had still not joined and I elected to conduct the hearing in their absence. I am satisfied that the notice of hearing has been correctly served.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 1 October 2025, following correspondence with the tenants where they had advised that they were looking to move back to the islands and sought to have the tenancy transferred to their niece, the landlord discovered that the premises had been abandoned.
- On 3 October 2025, a notice was issued to the tenants requiring them to reoccupy the tenancy. Following this there were two further visits to the property where communications and calling cards were left.
- On 30 October 2025, the landlord attended with a locksmith and access was gained. It was discovered that the premises have been emptied. Neighbours advised that removal trucks had attended the property and moved out the tenants’ possessions.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.
- In considering how much arrears owing I have considered that prior to vacate the premises the tenant and landlord had engaged in correspondence. The tenancy was nearly a decade old, and was a periodic tenancy. The tenants have failed to uphold their obligations to keep the landlord advised and to continue to pay their rent when due. Subsequently I award the full arrears which have been sought less the bond.
