- Edna Victoria Mailo owes Kāinga Ora–Homes And Communities $336.00 (“the debt”).
- Edna Victoria Mailo must pay rent and the debt as follows: a. By 8 weekly payments of $280.00, being $240.00 for rent and $40.00 for the debt. b. A final payment of $256.00, being $240.00 for rent and $16.00 for the debt. c. Payments will be every Wednesday, with the first payment on 15/04/2026 and continuing until 10/06/2026.
- Payments will be allocated in the following order: rent and the rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 17 Williams Crescent, Otara, Auckland 2023 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Mr van Gent attended the hearing for the landlord. The tenant did not attend.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- At the date the landlord filed the application the tenant was at least 21 days in arrears.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- While the tenant did not attend the hearing I am satisfied in this case by the landlord’s evidence that the Tenant will pay the rent arrears within the period set out in order 2. above. I say this for the following reasons: a. the tenant has been paying the rent and an additional $40.00 a week towards the rent arrears since 11 February 2026. b. all rent and rent arrears payments made since 11 February 2026 have been made by assignment of benefit c. the landlord’s evidence is that the tenant has been engaging with the landlord including regular contact to confirm the payments of rent and rent arrears are made.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
