- The tenancy of Milo Solo at Unit/Flat Flat 2, 39 Kimpton Road, Papatoetoe, Auckland 2025 is terminated, and possession is granted to Kāinga Ora–Homes And Communities, at 11:59pm on Monday 30 March 2026.
- Milo Solo must pay Kāinga Ora–Homes And Communities $1,400.00 immediately, being rent arrears to 30 March 2026.
Reasons
- Ms Maturan-Abuid, representing the landlord, attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing so did not attend the hearing. As the tenant was served, the hearing proceeded in his absence.
- The landlord has applied for termination of the tenancy and rent arrears.
- The landlord was open to the making of a conditional termination order, should the Tribunal be satisfied that such an order was appropriate. The evidence provided did not satisfy me that it is unlikely the tenant will commit any further rent breaches, especially given the rent payment history in the rent summary provided. Further, the tenant did not attend the hearing to provide evidence as to whether he could pay the rent arrears owing within a specified time either. The landlord said the tenant did not attend mediation either. As such, I decline to make a conditional termination order. See section 55(1A) Residential Tenancies Act 1986.
