The landlord attended the hearing. The tenants did not. I waited for 22 minutes for them to log into the video hearing or call one of the toll-free numbers on the notice of hearing. They did not. I am satisfied the tenants received two notices of hearing and several reminders of the date and time of the hearing and chose not to attend.

Not only did the tenants not attend the hearing at the scheduled time, they did not request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.

The landlord’s claims for compensation and exemplary damages for anti-social behaviour such as mental harassment, racist comments, criminal offending and bullying, all fall outside of the Tenancy Tribunal’s jurisdiction and are dismissed accordingly. Racist comments fall into the jurisdiction of the Human Rights Commission, criminal matters fall into the jurisdiction of the New Zealand Police and the type of mental harassment and bullying described could also fall into the jurisdiction of the New Zealand Police.
