Reasons
- On 16 January 2026, the landlord filed an application seeking termination of the tenancy and rent arrears.
- The hearing proceeded by way of video conference. Ms Jenni Davis, Senior Tribunal Adviser, appeared for the landlord. The tenant did not appear. The Tribunal was satisfied the tenant was properly served with the notice of hearing and the case proceeded in their absence.
- The Tribunal heard the tenant had reduced their rent arrears to $178.00 and an agreement to repay the outstanding rent debt had been agreed.
- On that basis the landlord withdrew their claim for termination of the tenancy and rent arrears.
- Under section 95A of the Act a party who has been either wholly or substantially successful is entitled to name suppression unless the Tribunal finds that there are reasons relating to the conduct of the party not to do so.
- Despite not being present the tenant has been wholly successful in defending the landlord’s application and is granted name suppression.
