Background
- The application seeks termination of the tenancy on the grounds that the tenant assaulted a neighbour.
- The hearing took place video conference on 4 February 2026. Ms Eder participated the hearing on behalf of Kāinga Ora. Ms Peihopa did not link into the video conference or telephone in using the phone numbers provided on the notice of hearing. The hearing proceeded in the tenant’s absence. 1 Law 1 Section 92 Residential Tenancies Act 1986 (“RTA”)
- The Tenancy Tribunal must make an order terminating the tenancy if the tenant has assaulted, or threatened to assault, any neighbour of the tenanted premises. 2 Findings
- Kāinga Ora alleges that Ms Peihopa assaulted a female neighbour on 19 November 2025.
- Kāinga Ora provided three video recordings. Kāinga Ora say that the recordings were taken from CCTV cameras located in the car parking area of this property. The recording shows two females engaged in a conversation outside the front of the tenanted premises. The conversation becomes more heated. One of the females then punches the other in the head / face. The victim retreats inside a house that is next to the tenanted premises.
- Ms Daniela (Kāinga Ora) gave evidence at the hearing. Ms Daniela confirmed that she knows the identity of the two persons shown the video. She said that the assailant is Ms Peihopa and the victim is Ms Peihopa’s neighbour.
- I was also provided with a written statement from the victim describing the incident and the impact it has had on her.
- My finding is that it is proven that Ms Peihopa assaulted her neighbour on 19 November 2025. The video evidence shows that her actions were not in self- defence or defence of another.
- Therefore, I must make an order for termination of the tenancy. Name suppression
- Kāinga Ora asked for the identity of the victim to be suppressed. The request is granted. 3
