Reasons
- Ms Armstrong attended the hearing on behalf of the landlord. There was no appearance for the tenant.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord had also issued a notice to remedy the rent arrears and that had not been rectified.
- The landlord provided rent records which prove the amount owing yesterday is $1920.00.
- The landlord would prefer the tenant to pay the rent arrears and continue in the premises, and had hoped the tenant would attend the hearing to discuss a conditional termination. I cannot make a conditional order unless I am satisfied that the tenant will pay the rent within a specified time and will not fall behind a again. Because the tenant did not attend the hearing, I did not have sufficient evidence on which to base a conditional order.
- I have made a termination and possession order. The landlord may choose to enforce that immediately. It must be enforced within 90 days of the date of this order or it will lapse (see section 64). It may be that the tenant can negotiate a repayment plan for her rent arrears in which case the owner may decide not to enforce the order.
- Because Gg Blue Enterprises Limited T/A Propertyscouts Manukau As Agents For Jenny Cho has wholly succeeded with the claim I must reimburse the filing fee.
