Reasons

Both parties attended the hearing. The landlord joined the hearing by video and the tenant joined by telephone.
The landlord claimed termination of the tenancy, rent arrears, a refund of the bond, and reimbursement of the filing fee.
Section 55(1)(a) of the Residential Tenancies Act 1986 (RTA) enables the Tribunal to terminate a tenancy when rent is at least 21 days in arrears on the date of the application was filed. The tenant was at least 21 days in arrears on the date the application was filed on 28 January 2026.
The landlord’s rent summary establishes that prior to today’s hearing the tenant paid all rent arrears owing. She has paid rent due for this rent week and has put a redirection in place to have rent paid from her benefit to the landlord commencing this week.
Section 55(2) provides that the Tribunal may refuse to make an order under s55(1) if it is satisfied that the breach has been remedied, the landlord has been compensated for any loss arising from the breach and that it is unlikely that the tenant will commit any further breach of a kind to which section 55(1) applies.
Having heard from the tenant about the cause of her past rent arrears, how she has paid the arrears and that she has the redirection in place, I am satisfied that this is a situation where I will refuse to terminate the tenancy.
Understandably the landlord is cautious about potential rent arrears in the future given the history of rent arrears. However he agrees that this gives the tenant the chance to show that she can pay rent due on a timely and consistent basis.
I have explained to the tenant that if she gets into arrears in the future and is issued with a 14-day breach notice which she does not remedy, or is at least 21 days in arrears at the date of the landlord filing a further termination claim, then it would be very unlikely that the Tribunal’s actions would be anything other than to terminate her tenancy.
While the landlord’s claim is dismissed for termination and rent arrears it is only just to award that the tenant reimburses the filing fee. The filing fee ($28.00) is the landlord’s loss arising from the tenant’s breach of failing to pay rent. 1 Accordingly this award is made.
The Tribunal on its own initiative orders suppression of the names of both parties and any identifying details including the tenancy address. In doing so I have had regard to the interests of the parties and the public interest and do not consider there is any public interest in having the names of the parties published.
