Reasons
- Only the applicant landlord attended the hearing, with two witnesses.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
Should the tenancy be terminated?
- The Tribunal may terminate a tenancy if the tenant has assaulted or threatened to assault any agent of the landlord. See section 55 (1) (c) (iii) Residential Tenancies Act 1986.
- The evidence establishes that the tenant has assaulted a contractor of the landlord attending at the property to prune trees back from the guttering, by throwing a chair at the contractor and then threatening him with gardening shears. A Police report was filed and the contractor provided evidence confirming the details of his statement were correct.
- A second witness confirmed the events had occurred as described,
- In a second incident the tenant threw a terracotta pot at a contractors van breaking the windscreen and a second pot at contractors on the driveway.
- As a consequence of these actions and the very real risk to contractors the landlord has a prohibition on any contractors attending at the complex until the tenant is removed.
- The nature and extent of the incidents/breach mean that it would be inequitable to refuse to terminate and that it is necessary to make the termination order immediate. See also section 56(1) Residential Tenancies Act 1986.
- As the breach was serious the landlord had warned the tenant about the likely consequences of continued breach. The nature of her correspondence in response is also considered as a reason the Tribunal must exercise its discretion to terminate immediately.
- Because Otautahi Community Housing Trust has wholly succeeded with the claim I have also reimbursed the filing fee.
