New Zealand Tenancy Tribunal Case 5447232 — 14-day notice

Reasons

The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The landlord advised that [The tenant/s] is currently incarcerated and will be for at least one more year (at the date of submission) due to his application for home detention being unsuccessful. An appeal regarding that decision was to be heard but no advice since has been received from him regarding any outcome.

The tenant has breached their obligations by failing to live at the premises.

The landlord served a 14-day notice on the tenant on 7 January 2026 and again on 17 February 2026. The tenant has been unable to remedy the breach within the required period.

It would be inequitable to refuse to terminate the tenancy because while it is clear [The tenant/s] seeks a release to home detention at this address, in the absence of that occurring imminently, there is a two-bedroom home that could be utilised by other people in need of such social housing.

This tenancy commenced in August 2025 and by today [The tenant/s] has been longer out of the home than resident.

The landlord emphasised its future role of providing housing support for [The tenant/s] at the appropriate time. Suppression

Section 95A RTA states regarding suppression orders that the Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.

Further, the Tribunal may, on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.

Apart from [The tenant/s] incarceration preventing his occupancy, rent is being paid and I heard of no other concerns regarding his tenancy. I consider it appropriate at this time to exercise my initiative and suppress his name and details.
