Chelsea Winstone must pay Kāinga Ora–Homes And Communities $100.00 on Tuesday 12 May 2026 and on Tuesday every week thereafter towards the debt in order 1 until the debt is paid in full.

Payments will be to rent and then to arrears.

If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at Unit/Flat 2, 48 Maanihi Dr, Rototuna North, Hamilton 3210 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

The applicant attended the hearing by video link. The respondent did not attend or answer the phone.

The landlord has applied for termination of the tenancy and payment of rent arrears. They tell me that they have a repayment arrangement in place and their preference is for a conditional termination order. Typically, a conditional order requires the presence of both parties so that the tribunal can satisfy itself that the arrangement is sustainable and realistic.

The rent summary however, shows that the agreement is already in place and I am satisfied that the conditional order is therefore sustainable and reflective of the respondents preference and in their interest.

I have reviewed the rent summary provided by the applicant. I am satisfied it is accurate. The applicant tells me since the summary was generated a further charge was made as well as a further payment received. I have accounted for this in the final figures reflected in my orders above.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
