The tenant or her co-tenant damaged the carpet by first spilling some fake blood on the carpet at Halloween and then accidently bleaching the carpet when they tried to clean the blood off.
The damage was more than fair wear and tear and was caused carelessly. The tenant is liable. However, the carpet was about 15 years old and was damaged in other areas. Carpets have an expected useful life of about eight years. This carpet was in barely fair condition even at the beginning of the tenancy. Five years on, it was fully depreciated. The tenant should not have to contribute to the expense of a new carpet when the original carpet needed replacing even absent the tenant’s damage.
Some minor wall damage occurred during the tenancy. A hole in the toilet door was caused by a door handle. That was probably due to the tenant’s children being too boisterous. There was some other wall damage which was slightly more than fair wear and tear. The tenant is liable in full for the toilet wall damage and liable at the rate of 50 per cent for the other more minor wall damage to account for depreciation. The tenancy was about five years duration, and the walls had not been painted for some years prior to the tenancy beginning. The walls, therefore, were due for repainting already. Filing fee and bond
