The tenant must by the 5.00pm Monday 1 June 2026, mow the premises’ lawns and weed and tidy its grounds.
As an alternative to complying with the work order in paragraph 1, the tenant must pay the landlord $1,500.00 immediately.
If the tenant fails to comply with the orders in paragraphs 1 or 2 above, then the landlord may undertake the work and charge the tenant the costs of this work up to $2,000.
The costs referred to in paragraphs 2 and 3 may be treated as rent in arrears and enforced accordingly.

The tenant has failed to maintain the premises grounds. The grounds are badly overgrown and unkempt. The lawns need to be mowed, and the grounds need to be weeded and tidied. Kāinga Ora wants this necessary maintenance work to be done.
Under section 40(1)(c) of the Residential Tenancies Act 1986, tenants must keep the premises, including the grounds, reasonably clean and reasonably tidy. This means tenants must mow the lawns and keep the grounds weed-free and tidy. Similarly, under clause 9 of the tenancy agreement, the tenant must, “look after your new home and grounds by keeping them tidy”.
Where the Tribunal finds that a tenant has failed to comply with their duty to keep the premises tidy, it may make an order for the tenant to carry out work to remedy the breach. 1

If the work order is not being made by consent of both parties as in this case, the Tribunal must also make a monetary order as an alternative to compliance with the work order. 2
