The hearing was conducted via teleconference.

Ms Tsourounakis attended the hearing on behalf of the landlord.

I attempted to contact all three tenants. Only Mr Putu initially answered the call. I asked him to remain on the line while I attempted to contact the remaining tenants, Ms Lardelli-Pirihi and Mr Raika. Mr Putu terminated the call.

I then attempted to call Mr Putu twice more and left voicemail messages on each occasion explaining the purpose of my calls. It appeared that Mr Putu chose not to engage further after becoming aware that I was contacting him in relation to the application before me.

I am satisfied that reasonable attempts were made to contact all tenants. None of the tenants participated in the hearing. In the circumstances, I proceeded in their absence.

The teleconference connection with Ms Tsourounakis was unstable, and she intermittently disconnected from the hearing. Despite these difficulties, the hearing was completed.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. Background

The landlord submitted that the tenants were in significant rent arrears and sought termination of the tenancy on that basis. During the hearing, Ms Tsourounakis also raised the possibility that the property had been abandoned.

Ms Tsourounakis gave evidence that she attended the property for an inspection after providing appropriate notice on 01 March 2026. On that occasion, no tenants were present, and entry was gained using a key. However, she confirmed that all of the tenants’ belongings remained in the property and that nothing had been removed. Abandonment

While there has been a lack of communication from the tenants and rent arrears have accrued, the evidence does not establish that the tenants have relinquished possession of the premises. In particular, the presence of the tenants’ belongings in the property indicates that they have not clearly vacated or given up possession.

Abandonment requires clear evidence that the tenants have left the premises without intention to return. That threshold has not been met in this case.

I am not satisfied that the tenancy has been abandoned. Conclusion

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy. Bond

The landlord informed me that there was a bond in the amount of $1,260.00 held by the Bond Centre.

I was uncertain whether this information was correct, as the teleconference connection was intermittent. I therefore contacted the Bond Centre to confirm whether a bond was held for the property.

The Bond Centre advised that there was no bond linked to the property. Accordingly, there was no bond available to be deducted for this property. Filing fee

Because Herhsv Limited has wholly succeeded with the application, I must reimburse the filing fee.
