Reasons

All parties, with the exception of [tenant 2], attended the remote hearing.

The first application (TT 5457270) was filed by [tenant 1]. The tenant applied for orders releasing her bond and reimbursement of the filing fee. The application was filed on 2 February 2026 and a notice of the hearing was sent to the parties on 11 March 2026.

On 19 May 2026 (the day before this hearing) the landlord filed a cross application (TT 5510015) against [tenant 1], [tenant 2] and [tenant 3]. That application seeks rent arrears, compensation, reimbursement of the filing fee and release of the bond.

I explained to the parties that I would be hearing TT 5457270 today but would be adjourning TT 5510015 and dismissing that application as it related to [tenant 1] only, for the following reasons.

The landlord had left it until the last day prior to the hearing to lodge the counterclaim. This in my view disadvantaged the tenants. They had the right to properly consider and prepare for a hearing.

The tenancy of [tenant 1] ended on 13 July 2025, by order of the Tenancy Tribunal under the domestic violence provisions of the Residential Tenancies Act 1986 (“RTA”).

The tenancy of [tenant 2] and [tenant 3] continued through until 22 August 2026.

As a matter of law, [tenant 1] could no longer be liable under that tenancy, with the exception of any rent arrears owing as of 13 July 2025. The landlord confirmed in evidence that the rent was not in arrears as of that date. The claim under TT 5510015 as it relates to [tenant 1] is dismissed.

The claim under TT 5510015 as it relates to [tenant 2] and [tenant 3] is adjourned for hearing at a later date. Bond

A bond is defined in s.2 RTA as: [a] sum of money payable or paid under a tenancy agreement as security for the observance and performance of the tenant’s obligations under the agreement and this Act.

The bond is the tenants’ money.

Section 22A and 22B RTA provide the mechanisms for how a party (landlord or tenant) can seek payment of the bond. A tenant can seek the bond any time after the tenancy ends under s22A RTA by applying to the Bond Centre. The Chief Executive will give notice to the landlord and the landlord has 10 working days to dispute the payment of the bond to the tenant. If the landlord disputes the payment of the bond, then the Chief Executive must advise the tenant on how to make a claim to the Tribunal.

The tenant is mistakenly under the misapprehension that having paid all of the bond personally, that she should be entitled to have that money refunded once she left the tenancy in July 2025. That is not correct. The bond is a security for the tenancy, and the tenancy continued with the remaining tenants. The bond needs to remain with the tenancy until the whole tenancy comes to an end.

The outgoing tenant has ‘withdrawn’ from the tenancy; the tenancy was not terminated – so the bond needed to remain in the Bond Centre. The domestic violence provisions of the RTA, do not include provisions around the release of the bond.

If the Tribunal were to find in favour of the landlord in TT 5510015 and released the bond to the landlord, the tenant [tenant 1] would have a potential claim against the remaining tenants for having incurred that liability.

The Tribunal has jurisdiction or power to hear claims between landlords and tenants. The Tribunal does not have jurisdiction to consider claims between tenants. If [tenant 1] wished to pursue the matter against the other tenants she would have to do so in another jurisdiction.

The application is dismissed. The tenant not having been wholly or substantially successful in this hearing no order is made for reimbursement of the filing fee.

Given the domestic violence background in this matter, [tenant 1]’s name and details are suppressed. The landlord applied for name suppression. The landlord’s name and details are to be suppressed.

I have suppressed the other tenants names while their hearing is adjourned.
