- Kalolo Melino Tau Maka owes Kāinga Ora–Homes And Communities $2,131.43 (“the debt”) as calculated in the table below:
- Kalolo Melino Tau Maka must pay rent and the debt as follows: a. By 106 weekly payments of $218.00, being $198.00 for rent and $20.00 for the debt. b. A final payment of $209.43, being $198.00 for rent and $11.43 for the debt. c. Payments will be every Thursday, with the first payment on 21/05/2026 and continuing until 01/06/2028.
- Payments will be allocated in the following order: rent and then rent arrears.
- If the tenant fails to pay rent and rent arrears within five working days of the due dates:
- When the debt has been paid in full the conditional termination order will lapse.
Reasons
- On 2 March 2026, the landlord filed an application seeking termination of the tenancy and rent arrears.
- The hearing proceeding by way of video conference. Ms Jan Maturan-Abuid, Senior Tribunal Adviser, appeared for the landlord. The tenant failed to appear. The Tribunal was satisfied the tenant was properly served with the notice of hearing and the case proceeded in their absence.

- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- At the hearing, the landlord told the Tribunal they no longer sought immediate termination of the tenancy and asked for a conditional termination order. The landlord wants the rent and rent arrears paid and asked the Tribunal to formalise the rent debt repayment plan the parties agreed at the beginning of March 2026.
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- The landlord has proved up to date rent records that prove the amount owed. The tenant was at least 21 days in rent arrears at the date the application was filed.
- There is sufficient evidence to order termination of the tenancy for rent arrears. However, I have been persuaded by the landlord’s evidence the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The tenancy is to continue on the condition that the tenant complies with the agreed repayment plan in addition to meeting all ongoing rent obligations as they fall due. The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
