- Mellissa Matthews must pay Kāinga Ora–Homes And Communities $2,095.00 immediately, calculated as shown in table below.
Reasons
- The landlord represented by Ms Rea, attended the hearing which was held by video conference. The tenant did not attend the hearing.
- The tenant has been served notice of the hearing to her email address. The landlord provided information which shows the tenant has provided an email address to the landlord to be used as an address for service. I have no reason to doubt the accuracy of this information.
- In the circumstances I am satisfied the tenant has been served lawful notice of the hearing, and I conducted the hearing in the tenant’s absence.
- The landlord has applied for termination of the tenancy and rent arrears.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- The landlord’s preference is for the termination order to be a conditional termination. This means the termination would only come into effect if the tenant breached the rent repayment conditions of the order.
- To make a conditional termination order, the Tribunal must be satisfied that the rent arrears will be repaid within a specified time, and there will be no further rent breaches. See Residential Tenancies Act, 1986 section 55(1A).
- I note the tenant did not attend the scheduled Mediation on 26 March 2026 and has not attended the hearing today or contacted the landlord or the Tribunal to explain their position. This indicates to me the tenant may not be motivated to be engaged with a resolution process.
- When I consider the rent history of the tenant I see that for the last seven weeks the tenant has been reliably making rent payments including and extra $52.00 per week to cover the rent arrears. I also see that prior to this fairly short period there had been a long period of the tenant falling further into rent arrears.
- I note the tenant is approximately $2,000.00 in arrears which means it would take the tenant approximately 40 weeks to pay off the arrears at the current rate with no breaches. This is a long period of time. I am not satisfied the tenant has a long history of meeting rent obligations on time.
- When I consider the above factors, I am not satisfied the tenant will pay the arrears within a specified time without further breaches.
- I therefore decline to make a conditional termination.
