The tenancy of Dax Taite and Josaia Matanakilagi Qalovaki at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 11:59pm on Sunday 3 May 2026.
Dax Taite and Josaia Matanakilagi Qalovaki must pay [The landlord/s] $1,343.00 (“the debt”) being:

Dax Taite and Josaia Matanakilagi Qalovaki must pay the next weekly rent of $490.00 on or before Wednesday 29 April 2026. If the tenants fails to do so a. the tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. the balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord attended the hearing which was held by videoconference. The tenants did not attend. Two calls were made to each of their numbers as given in the Notice of Hearing, which was properly served. All calls went to answerphone.
The landlord has applied for termination of the tenancy for breach of the tenants’ obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to pay the rent when due.
The landlord has served several 14 day notices requiring payment of the rent arrears, most recently on 18 March 2026.
Rent records provided by the landlord show that: a. an agreed payment arrangement put in place to repay rent arrears owing in December 2025 was stopped with arrears still owed; and b. though weekly rent has been paid, no payments toward the arrears have been made since December 2025.
It would be inequitable to refuse to terminate the tenancy because no recent attempt has been made by the tenants to address the rent arrears, despite the landlord’s attempts.
Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
