Reasons
- The landlord attended the hearing. However the tenant did not.
- I am satisfied that the notices of hearing and details of the claim were emailed to the tenant prior to the hearing via the email provided with the consent of the tenant.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 12 February 2025 the landlord received confirmation from a member of the clinical team associated with the tenant that the tenant was in jail. This was after the landlord carried out an inspection at the property on 6 January, when a neighbour told the landlord she believed the tenant was in jail. The tenant was not at the property during the inspection and others were living at the tenancy premises. The relevant Corrections Facility confirmed that the tenant was in jail on 5 March, however I find the landlord became aware or ought to have been aware that the tenant had abandoned the premises as he was in jail on 12 February.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
