The landlord has applied for rent arrears and has provided rent records which prove the amount owing up to tomorrow, 20 May 2026 is $470.

The tenant disputes that she is in arrears and says that if she borrows money and pays on a Wednesday, then she ends up $90 in credit.

Because some of the payments made have not been on a Thursday or have been for a different amount from the rent, the rent ledger balance has got out of kilter.

The tenancy agreement requires rent to be paid in advance weekly or fortnightly. Failure to pay rent in advance may not mean that the tenant is in arrears, but it is a breach of a term of the tenancy agreement.

The rent is due on a Thursday. Each Thursday the tenant must pay one week in advance. If she fails to do so, she may not be in arrears for the whole week, but as the week progresses, she will become further in arrears each day.

In an order dated 27 February 2025 1 , the Tribunal made an order for $600 for rent owed up to Wednesday 26 February 2025. That order was confirmed in a further order dated 1 August 2025. That amount was duly paid on Friday 8 August, leaving a balance of rent arrears owing to Wednesday 13 August 2025 of $470. When the tenant made a payment of $560 on Wednesday 13 August, she cleared those arrears and was then in credit by $90. But she had not paid her weekly rent in advance. She was paying rent on 13 August that was due the week before. Therefore, she was in arrears again within a matter of days.

Ever since then, the tenant has been either in credit by $90 (which is 1.125 days in advance or she has been in arrears by $470 (which is 5.875 days in arrears). She has not at any time been a full week in arrears.

The landlord wants the tenant to pay the rent each Thursday as required under the agreement.

As at today’s date, the tenant is only $390 in arrears. However, both parties want the rent to be paid on a Thursday. The amount owing up to and including tomorrow, Wednesday, is $470. The tenant must pay that amount to clear her arrears and then from Thursday 21 May onwards, she must pay her weekly rent of $560.

The tenant is frustrated because she believes she is now being required to pay a further week in advance. She says it has happened twice. Having reviewed the rent summary, I am not persuaded that she is correct. I can see no irregularity.

I note that the tenancy agreement provided for a letting fee of one week in advance. 2 That would not have been included in the rent summary. Apart from that, each week, the tenant is required to pay her rent on a Thursday to cover up to and including the following Wednesday.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee. 1 2 Letting fees have since been prohibited by section 17A of the Residential Tenancies Act, but could be charged at the time.

The tenant is allowed until the end of the month to make the payment of $470.00. It becomes due and payable on 31 May 2026. She must continue to pay her weekly rent. The next payment of $560 is due on Thursday 21 May.

I have granted name suppression to both parties. This is a small amount of rent arrears owing and the irregular payments have led to some confusion. I have therefore decided to suppress the tenant’s name on this occasion.
