Kāinga Ora claims the tenants have failed to keep the premises reasonably tidy and reasonably clean, including accumulating a large amount of rubbish and junk that is littered around the exterior premises. It seeks a work order to remediate the breach. Legal principles

Tenants must “keep the premises reasonably clean and reasonably tidy”. 1 Where the Tribunal finds the tenant has failed to keep the premises reasonably clean and reasonably tidy, the Tribunal may make an order for the tenant to carry out the work. 2

The photographs provided by the landlord from inspections on 10 October 2025 and 19 March 2026 show the outside of the premises is an eyesore. The premises looks like a derelict junkyard. As observed by the previous adjudicator there are large amounts of belongings and rubbish as listed in Order 1 above are strewn about the grounds, including six unregistered vehicles in various states of decay.

The lawns are overgrown and there are several makeshift sheds, car ports, or pergolas contributing to the sorely unkempt state of the property. Mr Temu says the structures are ramshackle and unconsented.

The landlord has sought quotations for removing the vehicles and rubbish, which are $6,453.00 to remove all the visible rubbish, and $5,000.00 to remove the wrecked vehicles. Further expenses than that may be required if the landlord must get its contractors to remediate the untidiness.

The tenants have clearly breached their obligation to keep the premises reasonably tidy. It is appropriate to make a work order to ensure the breach is remedied. Conclusion

I make the order set out above. Ideally, the tenants will do the clean-up work themselves. If not, the tenants will have to pay the landlord at least $12,000.00 or as much as $15,000.00 if the landlord’s costs of cleaning up amount to that figure.
