New Zealand Tenancy Tribunal Case 5465846 — Tenancy dispute

Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant name and identifying details and the tenancy address.
The tenant must carry out the following work to the premises, which must be completed by the dates listed: a. Immediately remove all electrical cords or connections to the carport and not put these back; and b. Immediately move all electrical appliances (eg stereo) to inside the house; and c. Must not park cars on the grass; and d. By 5:00pm on Tuesday 9 June 2026 must take down the torn and graffitied tarpaulin from the carport; and e. By 5:00pm on Tuesday 23 June 2026 must remove all outside rubbish from the property including all tyres and anything that is broken.
The tenant is allowed to keep:- a. the white boat, and b. anything that is working (for example, motorbike, scooter, bikes), and c. is allowed to put up a new tarpaulin or other shelter on one or two sides of the carport but must attach this securely and take it down if it gets graffitied.
The landlord may choose to agree with the tenant in writing that the tenant is allowed to keep a limited number of bikes to use for parts on any conditions the landlord might agree to (for example, that no more than 5 bikes be kept for parts, and these be stored only in a certain place).
This matter is decided by the orders above, but the landlord is allowed until 5:00pm on Friday 10 July 2026 to request the application be brought back to the Tribunal with new evidence that the orders in order 2 have not been complied with and the matter will be re-opened. The landlord should email remote.tenancy@justice.govt.nz and send a copy of all evidence to the tenant. Please refer to the application number in the subject line.
If the landlord asks for another hearing, then the Tribunal will decide whether to terminate the tenancy. The landlord must show that the tenant has not complied with these orders and that it would be unfair not to terminate.

The landlord has sent the Tribunal photos that show there is:- a. a large pile of rubbish outside the carport, b. another pile at the back corner of the property (near the garden shed), c. another pile near the washing line, and d. a few other items inside the carport and down the sides of the house.

Has the tenant failed to comply with their obligations?

The tenant agrees to remove the rubbish and says she has just got a quote for a large skip bin.
After talking about the issues, I agree that the property is not reasonably clean and tidy. I have made orders about what the tenant must do.
The most urgent thing is that the tenant must immediately turn off and remove all electrical cords or cables that go from the house to the carport. This might be unsafe, and someone could get hurt or killed by electric shock, or there could be a fire.
All electrical items must be moved from the carport to inside.
The torn and graffitied tarpaulin is not tidy and must be taken down by 5:00pm on Tuesday 9 June 2026.
All other rubbish must be removed from the property by 5:00pm on Tuesday 23 June 2026.
The tenant is allowed to keep the boat and anything that is working.
The tenant said that someone in her family likes doing work on bikes. The landlord might be able to agree on keeping some dismantled bikes in a tidy place.
The tenant says she will ask for help to order a skip bin and have the rubbish removed. If she does not do this by the dates I have listed, the landlord can ask for another hearing.
If there is another hearing, I will have to decide whether to terminate the tenancy.
The landlord has been successful with the application but as the government social housing provider responsible for the use of taxpayer funds, publication of its name is in the public interest. The landlord’s name is not suppressed.
I do suppress the tenant’s name on this order. She attended the hearing and agreed to remove the rubbish. If another hearing is required, I would probably not suppress her name.
