Ms Terblanche appeared for the landlord. Mrs Kornilov appeared for the tenant. Both appeared by video.

The tenancy commenced on 19 December 2025 and is for a fixed term ending 31 January 2027. On 26 February 2026, the landlord issued a 14-day breach notice to remedy rent arrears by 12 March 2026. On 13 March 2026, the landlord filed an application for termination of the tenancy and reimbursement of the filing fee. They are not seeking an order for refund of the bond.

The landlord has provided the tenancy agreement, 14-day notice, a rent ledger, correspondence with the tenant, and an up-to-date rent summary. Law

Under section 56(1) of the Residential Tenancies Act 1986 (Act), the Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

Under section 56(2) of the Act, where a landlord applies to terminate for breach under section 56(1), and the rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. Analysis and decision

The 14-day breach notice for rent arrears was not remedied. The last rent payment was a partial one made on 06 March 2026, and as at today’s hearing date the rent is at least 21 days in arrears (and is in fact over eight weeks in arrears).

The tenant accepts the arrears and states that they have advised the landlord of their intention to vacate the property next Wednesday. On that basis, they seek a deferment of termination to that date, stating that in the interim they lack means to secure alternative accommodation and are physically not in a position to vacate the property earlier. The landlord does not agree to delay and seeks immediate possession in order to mitigate their loss.

The rent arrears are significant. In the circumstances, I consider it appropriate to terminate the tenancy and grant the landlord possession at midnight on Friday 24 April 2026. I award rent arrears to that date. Costs

Because Harcourts Tawa Realty Limited as Agent for Reon and Rebekah Rogers has wholly succeeded with the claim I must reimburse the filing fee. Name suppression

Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that their name or identifying particulars of that party not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.

Although the landlord has been wholly successful, they do not seek name suppression.

Section 95A (4) further provides the Tribunal, on the application of any party to the proceedings, or on its own initiative, having regard to the interest of the parties and the public interest, may order that all or part of the evidence, or the name or any identifying particulars of any witnesses or party, not be published.

While Mrs Kornilov does not seek suppression for herself, she seeks it on behalf of the other tenant, stating that they have a role in sports development and that publication may pose a risk to reputation. On the material before me, I am not satisfied that such a risk is established or that it is sufficient to displace the principle of open justice. No suppression orders are made.
