Reasons
- Both parties attended the hearing by videoconference. The tenant frequently interrupted the landlord, and I ended the call when it became impossible to conduct the hearing. I was however able to hear from both parties.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The arrears are equivalent to about 18 weeks of rent (the current weekly rent is $455.00).
- The tenant referred to issues with flooding at the premises and a broken window. He acknowledged that he had stopped paying the rent because of these issues. The landlord said he was open to discussing the condition of the property with the tenant, but the tenant would not engage except at Tribunal hearings.
- There was a previous application for rent arrears (5420967). In an order dated 16 March 2026 the Tribunal encouraged the tenant to provide the landlord with a list of maintenance issues and pointed out that the tenant could lodge a claim with the Tribunal. It was evident from the discussion today that the tenant has not done this and gave no indication that he will. No evidence was provided to support the tenant’s maintenance concerns.
