Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- In early November 2025 the tenant failed to pay rent, the landlord issued a 14 day notice to the tenant requiring the tenant to repay the rent arrears. Around the same time the tenant contacted the landlord and advised that he was currently away from the property as he was frightened to return. When the 14 day notice expired the landlord gave notice to the tenant that it would inspect the property on the 15 January 2026 to determine if the tenant had abandoned the property.
- The landlord inspected the property on the 15 January 2026 and found that whilst some of the tenant’s items/belongings were still in the house, there was no food in the cupboards and the beds had been stripped of linens. The tenant appeared to have taken his clothes as well. The tenant has made no contact with the landlord since November 2025 and has paid no rent.
- I am satisfied has abandoned the premises. It appears from the inspection photographs that he is not living at the premises.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice. I consider that the landlord ought to have been aware that the tenant had abandoned the premises on the 15 January after conducting its inspection. The landlord is entitled to rent for 21 days after that date.
