Kāinga Ora–Homes And Communities must take any of the tenant’s personal documents, if any, that have been left at the premises to the nearest Police station and obtain a receipt for them.
The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.
[The tenant/s] must pay Kāinga Ora–Homes And Communities $580 immediately being storage costs for items left at the premises.

Reasons

Only the landlord attended the hearing. I am satisfied that the tenant has been served and so the hearing proceeded in her absence.
The landlord seeks an order to dispose of the tenant’s goods that were left in the premises after the tenancy ended and an order for the costs of storing the items.
The landlord application form only referred to an order requiring disposal and did not refer to storage costs. However, a succinct written page of submissions filed with the application refers clearly to seeking storage costs and two months of storage costs invoices were also filed in advance. I am therefore satisfied that the tenant has notice that the landlord is seeking storage costs of $580 as well as an order seeking disposal of those goods.
The tenancy ended following an order of the Tribunal which ordered that the tenancy end on 5 January 2026.
I heard how the tenant left on 30 January 2026 and her belongings were placed into storage by the landlord. A detailed inventory of the items and photographs were provided. While there are some larger items (such as a couch, fridge and washing machine) the majority of the items are smaller miscellaneous items.
The tenant did attempt to collect her goods on one occasion, but the goods were not collected as the tenant got upset. The landlord submitted that staff attempted to guide her to the process for collection of her goods, which includes attending the facility with staff, Ms Te Kata attending with a method of transporting her goods and possible Police presence. It was submitted that during this interaction Ms Te Kata’s behaviour deteriorated and she was asked to leave, which she did.
I heard how she was not trespassed from the landlord’s office so could have returned to the office or called the landlord’s freephone number to discuss the return of her goods but this was not done.
The landlord has been unable to contact the tenant and it is not practicable for the landlord to return the goods to the tenant.
At this time of the application the landlord says the goods have been in storage for about three and a half months (said to be at the cost of $1,015). I am satisfied that the cost of storage, transport and sale exceeds the value of the goods. Therefore, the landlord may dispose of the goods in any way they see fit.
The landlord says it has incurred $1,015 in storage costs, but the application has only given sufficient notice to the tenant of a claim of $580 ($290 per month x 2 months). Therefore, I limit this application to that sum. In any event, there are also no other invoices available to support an award of over $580.
