- The tenant must carry out the following work to the premises, which must be completed by 5 June 2026: a. Mow all the lawns including the back section to ensure the lawns are reasonably tidy.
- As an alternative to compliance with Order 1, the tenant must pay the landlord $1,850.38 immediately after 5 June 2026.
- If the tenant fails to comply with either Order 1 or 2 above, then the landlord may undertake the work and charge the tenant the costs of this work up to $1,850.38. These costs may be treated as rent in arrears and enforced accordingly.
Reasons
- Ms Perese represented the landlord. The tenant did not attend the hearing.
- The landlord claims that the tenant has failed to mow the lawns at the tenancy premises, a breach for which the landlord issued a 14-day compliance notice on 12 January 2026.
- A tenant has specific obligations in relation to the tenancy premises. A tenant must keep the premises, including the exterior, reasonably tidy 1 .
- When the Tribunal finds that the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work 2 .
- If the work order is not being made by consent of both parties, the Tribunal must also make a monetary order as an alternative to compliance with the work order.
- A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work, if the tenant should fail to comply with the work order and alternative monetary order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly 3 .
Has the tenant failed to comply with their obligations?
- The landlord produced a copy of the breach notice dated 12 January 2026 and photos of the lawns taken recently which show that the tenant has breached her responsibility to keep the lawns reasonably tidy.
- The landlord also produced a quote for the lawn work that is required.
- I have made an order for the tenant to complete the work by 5 June 2026 and an alternative money order for non-compliance.
- If the tenant does not complete the work and does not pay the landlord the sum ordered to be paid as an alternative, the landlord can proceed to have the work done after 5 June 2026. The cost of the work can be treated as rent arrears.
