Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the tenant’s name and identifying details.
- The tenant must carry out the following work to the premises, which must be completed by Wednesday 13 May 2026: a. Remove all unauthorised additions and modifications attached to the fence and reinstate the fence to its original state.
Reasons
- Both parties attended the hearing via teleconference.
- The landlord claims that the tenant breached clause 30 of the tenancy agreement by attaching wooden pallets and other timber structures to the top of the existing fence to increase its height. Clause 30 states that the tenant must not make any alterations, additions, or modifications to the premises without the landlord’s prior consent. The landlord said that the existing fence was not engineered to support the additional weight of the structure and was creating a safety risk. The landlord wanted the problem fixed.
- The tenant accepted having attached the timber structures to the top of the existing fence. The tenant also agreed to have them removed.
- Accordingly, I order the tenant to remove all unauthorised additions and modifications attached to the fence to reinstate the fence to its original state by Wednesday 13 May 2026.
- The landlord reminded the tenant that she was currently keeping her dog without consent from the landlord. As there is a new procedure in place for dogs, the tenant is encouraged to go and speak to her tenancy manager to get the dog properly approved. If the dog remains unapproved, the landlord can escalate the issues matter in the future.
