Reasons

Background

The order dated 15 May 2026 sets out the background to the applications and my findings in respect of the status of the landlord’s termination notice, and the tenant’s claim for exemplary damages in respect of the late lodgement of the bond.
In this order I set out my findings in respect of [The landlord]’s claim for outgoings arrears and I make monetary orders to conclude the proceedings. Outgoings
The agreement provided that [The tenant/s] would pay $60 per week, in addition to the rent of $650 per week, towards outgoings (power and internet).
[The landlord/s] provided a payment record showing that [The tenant/s] had paid $2,580.00 towards outgoings as at the date of hearing (13 May 2026). This included a payment of $60 on 11 May 2026.
This is confirmed by [The tenant/s]’s bank statements. [The tenant/s] provided his statements on 19 May, so they also include a payment of $60 on 18 May.
[The tenant/s] wrote a note on his statement evidence as follows:
5.25 – 13.5.26 This time period is exactly 49 weeks + 3 days. Total amount due is for 49 weeks not 50 weeks
This is response to my comment in the 15 May decision that: At the date of hearing, [The tenant/s] should have made 50 payments of $60, a total of $3000.
Upon reflection I agree that it tidiest to deal in whole weeks. Therefore, I have calculated outgoings arrears as follows: a. [The tenant/s] should have paid $2,940 in outgoings for the 49-week period from 31 May 2025 to 9 May 2026. b. [The tenant/s] paid $2,520 over that period. I cannot include the $60 payments that he made on 11 May and 18 May 2026, as those are payments for weeks 50 and 51. c. I accept [The tenant/s]’s argument that [The landlord/s] agreed to waive payment of rent and outgoings for one week in exchange for work that [The landlord/s] carried out. d. [The tenant/s] has paid a total of $2,580 (bank transfers plus work). e. There are proven arrears of $360 to 9 May 2026. Filing fee, name suppression
