The landlord attended the remote hearing.

The tenant did not attend the hearing by Teams video link or by telephone. The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. I am satisfied that notice of the hearing was given.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy is $13,518.56

I have considered the obligation on the landlord to take all reasonable steps to limit the damage or loss arising from the tenant's breach of their obligation to pay rent (s.49 Residential Tenancies Act 1986).

Consideration of that issue will be case specific. This was a long tenancy having commenced in 2021. For nearly all the tenancy the tenant has complied with the rent obligations. In Huang v Ashworth [2024] NZDC 15726 the District Court held in considering a similar lengthy tenancy and allowing rent arrears to accumulate to four months. The District Court held “I consider that Mr Huang’s attempts to resolve the issue of rent arrears without resorting to eviction were reasonable, especially for a tenancy that had lasted close to four years. But I qualify that; It is reasonable only up to a point.” The court went on to allow arrears of four months to be claimed.

I propose adopting a similar course. The arrears to the date of filing this application with the Tribunal equated to approximately four months’ rent. Arrears have accrued since that date whilst the landlord attended mediation and waited for a hearing date.

The full rent arrears are ordered.
