The landlord explained the difficulties and delays he faced with the insurance company, and with the availability of contractors to conduct repairs, and said he has a waiting list for this property, which is part of a complex he owns with five other units. On the other hand, four months is quite a long period of time for any renovation outside of the holiday period. I understood from the landlord that a building consent was not required. Further, some of the repairs appear to relate to water damage and the tenant’s responsibility for this is unclear, for example, in relation to a leak from the kitchen sink. I award compensation for loss of rent due to the need for repairs for 4 weeks at $440.00 per week ($1,760.00). Tenant Damage

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.

The insurance company’s explanation of how the excess had been applied noted damaged walls in the living room, a damaged door and wardrobe door in the bedroom, water damage to the flooring in the kitchen (assessed as intentional) gradual water damage to the kitchen benchtop and cabinets, a damaged toilet, water damage to flooring in the kitchen, and holes in the walls and water damage in the laundry.

The landlord’s photographs paint a picture of a badly damaged property left in a very untidy condition.

The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. I award the insurance excess of $5,600.00.

I note that the landlord said he was not claiming damage to the flooring. The insurance excess was applied to other damage which insurers considered intentional. This resolves any concerns there might be about whether the state of the flooring shown in the landlord’s photographs was caused by the tenant.
