Reasons

Both parties attended the remote hearing.
The landlord has applied for possession of the premises following the termination of the tenancy.
The landlord rents the premises from a third party and sublets them to the tenant. On 7 February 2026, the landlord received a 90-day notice to terminate the tenancy. The tenancy under that notice was to end on 11 May 2026.
On 9 February 2026 the landlord gave the tenant a 90-day notice to terminate the tenancy with the tenancy ending on 10 May 2026. The tenant remains at the premises.
The tenant says that the notice is retaliatory under s.54 Residential Tenancies Act (“RTA”) 1986. I do not consider on the evidence the landlord was motivated in part or wholly by the exercise by the tenant of any right, power, authority, or remedy conferred on the tenant by the tenancy agreement or by the RTA. The landlord having received notice to terminate from its landlord was obliged to give the tenant notice.
The tenancy ended on 10 May 2026, which is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied.
As [The applicant/s] has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee.
Both parties applied for name suppression. The landlord has been wholly successful in this hearing and suppression of the landlord’s name and details is ordered. The tenant has not been wholly or substantially successful in this hearing. The tenant’s application for name suppression is dismissed.
