Reasons

Both parties attended the remote hearing.
The landlord has applied to the Tribunal for an order terminating the periodic tenancy on the grounds of anti-social behaviour from the tenant or someone on the premises with the tenant’s permission.
The landlord states that the anti-social behaviour is;
On 8 February 2026 the tenant was playing loud music and revving his car at his premises. The tenant was swearing and yelling at nothing in particular. The tenant became involved in a verbal altercation with a neighbour (“Mr A”). The tenant tried to instigate a physical fight and told the neighbour to “sleep with one eye open”. Mr A said that his two young grandchildren were present when this occurred and that they had been detrimentally affected by the tenant’s actions. He said that they felt unsafe. The grandchildren no longer went outside to play games. Mr A said that they felt like prisoners in their own home
On 20 February 2026 at approximately 2 pm, Kainga Ora staff attended at the tenant’s property and knocked on the door. The staff wanted to talk to the tenant about his behaviour and to arrange for an inspection. The tenant yelled and used obscene language. The tenant told the staff to “Fuck off you cunts...get the fuck off my property. The staff member who gave evidence said that the tenant spoke loudly and in an aggressive tone. The staff member said that she felt unsafe and immediately left the premises.
On 13 March 2026, the tenant was standing at the back door of his home. He was using obscene language. Mr A approached the tenant and asked him to stop using obscene language. The tenant verbally threatened Mr A and once again said “sleep with one eye open cunt”. Mr A’s two young grandchildren were present and saw the incident occur. Not surprisingly, they became frightened.
The tenant’s evidence was that Mr A never spoke to him politely. He said that he had been having mental health issues following the death of his father and a motor vehicle accident. He was apologetic to the Kainga Ora staff. He said that he did not mean anyone physical harm and that he should have handled things differently.
Subject to certain considerations, the Tribunal must make an order terminating the tenancy if it is satisfied: a. on 3 separate occasions within a 90-day period the tenant, or a person in the premises with the tenant’s permission, engaged in anti-social behaviour in connection with the tenancy; and b. on each occasion the landlord gave the tenant written notice— i. describing clearly which specific behaviour was considered to be anti- social and (if known to the landlord) who engaged in it; and ii. advising the tenant of the date, approximate time, and location of the behaviour; and iii. stating how many other notices (if any) the landlord has given the tenant under this paragraph in connection with the same tenancy and the same 90-day period; and iv. advising the tenant of the tenant’s right to make an application to the Tribunal challenging the notice and; c. the landlord’s application to the Tribunal was made within 28 days after the landlord gave the third notice.
The Act confirms that antisocial behaviour includes harassment or any act (whether intentional or not) that reasonably causes alarm, distress or nuisance that is more than minor.
I have taken into account the evidence presented by the parties as set out above.
I have determined that the landlord has established that anti-social behaviour has occurred on the premises by the tenant. The landlord has served notices on the tenant as required in the Residential Tenancies Act 1986, and the application to the Tribunal was made within 28 days of the date of the third notice.
I consider it would not be unfair to terminate the tenancy taking into account the circumstances in which the behaviour arose and the notices were given. I cannot see that the landlord has acted in any retaliatory way in bringing this application.
Section 55A (4) RTA provides that the Tribunal cannot consider the impact on the tenant, in making an order for termination of the tenancy.
The tenancy is terminated.
The tenant applied for name suppression. The tenant has not been wholly or substantially successful in this hearing. The application for suppression is dismissed.
