The tenant advised that she would be at the hearing. The tenant has not communicated with the Tribunal seeking an adjournment. I am proceeding with the hearing in the absence of the tenant.

The neighbours have been complaining about the terrible smell coming from the property. As a result of the complaints and after serving notice to inspect the property, the landlord went inside the property. The landlord stated that the property is in a poor and unsanitary condition, with food waste and rubbish left throughout.
The landlord provided photos of the inside of the property, and it was in a terrible state with rubbish and possessions piled up all over the property.
The landlord has been able to talk to the tenant the day before the hearing. The tenant is living on the streets and sleeping rough in South Auckland. The tenant says she feels unsafe at the property but does not wish to have the tenancy terminated.
After evidence from the landlord about talking to the tenant who confirmed she was not residing at the property, the complaints from neighbours and the photos of the inside of the property, I am satisfied that the tenancy should be terminated and immediate possession given to the landlord.
Section 91AA of the RTA allows the Tribunal to terminate a tenancy on the grounds of abandonment if satisfied that the tenant has abandoned the premises.
The fact that the tenant is in rent credit does not prevent the Tribunal from making a termination order if abandonment is established.
Based on the evidence provided, I am satisfied that the tenant has abandoned the premises.
The tenancy at 815/140 Hobson Street, Auckland Central Business District is terminated as of the date of this order.
Possession of the premises is granted to the landlord immediately. Cleaning and Rubbish Removal:
The landlord entered the premises after giving the required notice and found the property in a filthy condition, with food waste, scraps, and discarded possessions throughout. There was no value in the items left behind.
Due to the health and safety risk posed by the state of the property, and complaints from neighbouring apartments about odours and rubbish, the landlord arranged for immediate removal and cleaning.
The landlord has provided evidence of the costs incurred for the removal and cleaning of the property. The invoice for the cost of the cleaning and rubbish removal was $1730.00 dated 31 March 2026. The items left behind had no value and required urgent disposal due to health and safety concerns.
I am satisfied that the landlord has proven their claim for the cleaning and rubbish removal costs. Rent credit/Bond:
The tenant owes the landlord the sum of $1730.00 for the rubbish removal and cleaning. The tenant has $$312.00 and the bond centre and the rent credit of $1170.00.
The Bond Centre is to refund the bond to the landlord immediately to offset the debt owed by the tenant to the landlord.
The landlord is to use the rent credit to offset the debt owed by the tenant to the landlord, as set out in paragraph 3 of this Order.
The landlord has applied for suppression of their name, address and identifying details and as they have been successful, I will grant suppression.
The landlord does not seek to claim the remaining debt of $248.00 and the remaining debt is forgiven.
