- [The tenant/s] owes Kāinga Ora–Homes And Communities $2,391.10 being rent arrears owed to 23 June 2026.
- [The tenant/s] must pay rent and rent arrears as follows: a. By weekly payments of $199.30, being $178.00 for rent and $21.30 for the debt. b. Payments will be made every Thursday, with the first payment on 25 June 2026 and continuing until the debt is paid.
- Payments will be allocated in the following order: current rent, then rent arrears.
- If the tenant fails to pay current rent and rent arrears within 5 working days of the due dates set out in order 3: a. The tenancy at 49 Speargrass Grove, Timberlea, Upper Hutt 5018 will terminate and the landlord will have immediate possession of the premises. b. Reasons
- The landlord attended the hearing, represented by Ms Gray.
- The landlord has applied for termination of the tenancy, rent arrears. The tenant has been repaying the debt by instalments of $21.30.
- Rent was at least 21 days in arrears on the date the application was filed and so the grounds for termination are established. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing to today is $2,391.10.
- The tenant has been paying off the debt with payments of $21.30. Earlier this year, the tenant missed some payments. She later rectified the situation, but the landlord wants the arrangement formalised into a conditional termination order so that if the tenant misses payments in the future, the tenancy will terminate and possession will be given to the landlord.
