Reasons

The applicant attended the hearing. The respondent did not.

The landlord has applied for a conditional termination order. The landlord has provided rent records showing the amounts owing as at 20 July. I am satisfied that those records are accurate and correctly record the rent arrears. I have added a further two days' rent to reflect the amount that will be owing on the next rent payment date, being Thursday, as the rent summary indicates that the tenant usually pays on Thursdays.

Where rent is at least 21 days in arrears on the date the application was filed and the landlord seeks termination, the Tribunal must make either a final termination order or a conditional termination order. See sections 55(1)(a) and 55(1A) of the Residential Tenancies Act 1986.

A conditional termination order is ordinarily made where the tenant is present so that the Tribunal can assess whether the conditions of the order are likely to be sustainable. In cases where the tenant is not present, this can be inferred from the tenant's recent payment history, particularly where that history demonstrates that a payment arrangement is already being maintained.

This case presents an additional consideration. Although there is a payment history, the tenant's income-related rent has changed this week. Accordingly, it is not yet known whether payment of the current rent together with an additional $20 per week towards the arrears will be sustainable.

However, the alternative is to terminate the tenancy. I am satisfied that the proposed arrangement is likely to be sustainable and, in any event, the order places the responsibility on the tenant. If the tenant wishes to continue the tenancy, they need only comply with the conditions of this order. If they do not, the tenancy will terminate and the balance of the debt will become immediately due and payable.
