Both parties attended the hearing by video/ teleconference. Interpreter support was provided. Background

The parties entered into a fixed term agreement from 26 July 2024 to 25 July 2025. It was then renewed for term ending 25 July 2026.

Unfortunately [redacted] lost his job. The tenants asked to be released from the fixed term because they could no longer afford the rent. The application was made on 2 March 2026, proposing that the tenancy end on 27 March.

The tenants paid rent to 26 March and moved out. No rent has been paid since then.

The landlord has made extensive efforts to re rent the premises but has had little interest. The rent being asked has been reduced, which the property manager is hopeful will enable new tenants to be found.

The evidence satisfies me that the landlord has met its obligation to take reasonable steps to mitigate the loss caused by the tenants’ breach. 1 The Issue

The question is whether, as the tenants request, the Tribunal should terminate the tenancy before the fixed term ends on 25 July. If no replacement tenancy is found before then, unpaid rent will have accumulated to $11,667.86.

The Tribunal may reduce a fixed term tenancy where: a. there has been an unforeseen change in the applicant’s circumstances; and b. there would be severe hardship to the applicant if the term is not reduced; and c. the applicant’s hardship would be greater than the hardship to the other party if the term is reduced. See section 66(1) Residential Tenancies Act 1986.

The evidence shows that there was un unforeseen change in the tenants’ circumstances that brought this situation about.

Accumulation of debt, to the amount possible if the tenancy continues to the end of the fixed term, would cause the tenants severe hardship.

The landlords’ situation is such that hardship will also be caused if no rent is received from the property. 1 See s.49 RTA

The landlord accepts that it would be unfair to hold the tenants liable for rent until the end of the tenancy. The landlord does have some options to mitigate the hardship caused through the loss of rent by making it attractive for new tenants to rent, or through sale.

The period from the date rent is paid to, 27 March 2026 and the date rent is payable to 25 July 2026, is 120 days.

I have assessed 21 May 2026 as the date on which the tenancy should end as being 8 weeks from the date the tenants vacated and approximately 50% of the period between then and the fixed term end date.

The rent currently owed is more that the bond held, which should be released to the landlord immediately.

Both parties have brought valid applications and no order is made about the filing fee.
