Reasons

Both parties attended the hearing.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The landlord has provided rent records which prove the amount owing.

The tenant has made a payment in the last few days which has substantially reduced the debt. The landlord wants an Order terminating the tenancy given a history of difficulties with timely payment of the rent.

Having heard from the parties and considered the rent records, I am satisfied the tenant should be given the opportunity to fully repay the debt and demonstrate that he is able to maintain regular payments of the rent on due date, which the landlord is entitled to.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

I note that the amount ordered takes into account a rent adjustment for a power outage in September 2025, which the landlord was aware of and had made some allowance for. The tenant sought to raise other compensations issues but they will need to be by way of a separate application, properly notified to the landlord.

Because Dusanka Dante Moulton has succeeded with the claim I must reimburse the filing fee.
