Order
- The Tribunal orders suppression of the tenants’ names and identifying details
- [The tenant/s] owe Kāinga Ora–Homes And Communities $321.00 (“the debt”) for rent arears to 15 July 2026.
- [The tenant/s] must pay rent and the debt as follows: a. by a payment of $228.00 for weekly rent on 16 July 2026; b. by 10 weekly payments of $258.00, being $228.00 for rent and $30.00 for the debt; c. by final payment of $249.00, being $228.00 for rent and $21.00 for the debt. d. Payments will be every Thursday, with the first payment on 23/07/2026 and continuing until 1 October 2026.
- Payments will be allocated in the following order: rent and rent arrears.
- If the tenants fail to pay rent and rent arrears within 5 working days of the due dates: a. the tenancy at 8 Hobman Place, Manurewa, Auckland 2102 will terminate and the landlord will have immediate possession of the premises. b. the balance of the debt will be payable immediately.
- If the tenants’ income related rent changes, the payments required under Order 2b will be the weekly assessed rent plus $30.00.
Reasons
- The landlord attended the hearing by videoconference. The tenants did not attend and neither was able to be contacted by phone.
- The landlord has applied for a conditional termination Order.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- The rent arears have been reduced since the date the application was made but there are arrears still owed.
- I am satisfied the tenants should have the opportunity to repay the debt within the period specified in the order. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
