Reasons

The landlord attended the hearing which was held by videoconference. The tenant did not attend. The Tribunal attempted to contact the tenant on the telephone number provided in the application, but without success. I am satisfied that the notice of hearing was properly served on the tenant. In the circumstances, I considered it reasonable to proceed with the hearing in the tenant’s absence.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

The tenancy commenced on 5 December 2025. It was a fixed-term tenancy due to expire in December 2026. The rent is $650.00 per week. A bond of $2,600.00 was paid and lodged with Tenancy Services. Rent Arrears and Termination

Section 40(1)(a) of the Act requires a tenant to pay rent when it falls due. Payment of rent is a fundamental obligation under every tenancy agreement.

Section 55(1)(a) of the Act provides that the Tribunal must terminate the tenancy if, at the time the application is filed, the tenant is at least 21 days in arrears with the rent.

The landlord explained that this is the second application to the Tribunal relating to rent arrears under this tenancy. Although earlier arrears were paid, the tenant has again fallen behind and has demonstrated a pattern of irregular payments since the tenancy began. The landlord said this has caused financial strain to the property owner.

The landlord produced a rent summary, which I accept as accurate and reliable evidence of the tenant’s payment history. The application was filed on 28 April 2026. The rent records establish that, at that date, the tenant was already more than 21 days in arrears. The statutory threshold under section 55(1)(a) was therefore met when the application was filed.

By the date of the hearing, the arrears had increased to $2,600.00.

I am satisfied that the landlord has proved the claim for rent arrears and that the requirements of section 55(1)(a) are met. In those circumstances, the Act requires the Tribunal to terminate the tenancy. Once the statutory criteria are established, the Tribunal has no discretion to decline termination.

Although this was a fixed-term tenancy, section 55 applies equally to fixed-term tenancies. A substantial breach by the tenant through non-payment of rent entitles the landlord to termination notwithstanding the agreed fixed term.

The tenancy is therefore terminated. Fixed-Term Losses and Letting Fee

The landlord also noted at the hearing that, because the tenancy was for a fixed term, they wished to seek compensation for loss of rent until a replacement tenant is found and reimbursement of a letting fee.

These claims were not included in the original application. As a result, they are not properly before the Tribunal and cannot be considered in this proceeding. It would be procedurally unfair to determine claims for which the tenant was not given notice.

This decision does not prevent the landlord from filing a further application if they wish to pursue those claims. Filing Fee and Suppression Order

As the landlord has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee.
