The tenancy of Carla Jane Woodhams and Odean Rea Thompson at Unit/Flat Flat 1E, 238 Karangahape Road, Auckland Central, Auckland 1010 is terminated, and possession is granted to Goode Property NZ Limited As Agent For Jeanette Singh immediately.

The Bond Centre is to pay the bond of $3,750.00 (BN-32609534) to Goode Property NZ Limited As Agent For Jeanette Singh immediately. This is to be applied against rent arrears.

Carla Jane Woodhams and Odean Rea Thompson must pay Goode Property NZ Limited As Agent For Jeanette Singh $28.00 immediately, being the filing fee.

Reasons

The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any prior contact with the Registry. A call to the tenant was attempted but unsuccessful. I was satisfied adequate service had completed so that both tenants should have been aware of this application. I continued with the hearing after the call went unanswered.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. A late variation also sought recovery of Body Corporate charges. These are significant costs and require further evidence as well as adequate service on both tenants before any determination.

When considering claims, the Tribunal must consider s 85 RTA which provides that the Tribunal shall determine a dispute according to the substantial merits and justice of the case and in doing so, shall have regard for the law but shall not be bound to give legal effect to strict legal rights or obligations or to legal forms or technicalities. This provision recognises that, although applying established legal principles will generally produce a fair result, there are circumstances where it will not. In this situation, the Tribunal is entitled to depart from the strict application of the law to achieve a just outcome. Equally, where the law is uncertain, the Tribunal may adapt an approach that best meets the merits and justice of the case.

There are two tenants but only one was named in the Tribunal application 1 . Given the significant rent arrears it would be inequitable to require further service before any termination and possession orders. However, I decline to make any monetary orders at this time, other than the filing fee. The landlord is to include a final claim for rent arrears, reflecting the bond of $3,750.00 as released by this order. Both tenants will have an opportunity to respond to the rent arrears, as well as any other landlord claims, at the next hearing. That hearing can be heard by any adjudicator.

The landlord provided rent records which prove the amount owing at the end of the tenancy, today, 30 June 2026, is $8,035.71. The tenancy only commenced on 10 April 2026 and no rent has been paid since the first week of rent was paid at commencement.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986. 1 Odean Rea Thompson was omitted from the application but the landlord confirmed this was an administrative oversight in filing and she remains in the tenancy as a second tenant, per the tenancy agreement. Because Goode Property NZ Limited As Agent For Jeanette Singh has substantially succeeded with the claim I have reimbursed the filing fee.
