- [The party] and [The party] owe Inspire Property Management Limited as agent for Bing Bing Huang $2,583.00 (“the debt”), calculated as shown in the table below.
- [The party] and [The party] must pay rent and the debt as follows: a. By paying the landlord the $2,583.00 debt by no later than Friday 17 July 2026. b. By continuing to pay weekly rent of $430.00 every Friday commencing Friday 17 July 2026 and continuing until Friday 2 October 2026.
- If the tenants fail to pay the debt or the weekly rent within 2 working days of the due dates: a. - The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenants want to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- The tenants’ rent was more than 21 days in arrears when the landlord filed its application. Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order pursuant to s 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenants will pay the debt within the period specified in the order and are unlikely to commit any further relevant breach during the specified term if MSD is prepared to assist them to keep the tenancy by paying the tenants’ rent as required above. Given the tenants’ difficult circumstances, there is a reasonable prospect that MSD will provide the tenants with the emergency assistance they need to keep living in the premises. Therefore, I grant a conditional termination order.
- The landlord provided a rent summary that proves the rent arrears are as set out in the table above. The tenants must also pay the rent from today to Thursday, and the filing fee. That amount which totals $2,583.00 must be paid by next Friday. Thereafter, the tenants must pay weekly rent on pain of termination until 2 October 2026. They must continue to pay weekly rent after that date, but if they do not pay rent the termination would not be immediate and automatic.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach pursuant to s 64(4)(b) of the Residential Tenancies Act 1986.
